Despite insolvency of ELS: disposal of sales packaging is ensured

Cologne. The nine dual systems remaining after the planned opening of insolvency proceedings by the dual system ELS, have reached an agreement on ensuring disposal and recycling of sales packaging in the period from opening the insolvency proceedings, and suggested an appropriate solution for ELS. The uncertainties caused by the ELS insolvency, and speculations regarding the security of the disposal of sales packaging in Germany, would therefore be quickly dispelled. 

“Our offer is on the table. A pragmatic and practicable solution is found, to be able to further guarantee disposal safety in Germany“, says Markus Müller-Drexel, Managing Director of INTERSEROH Dienstleistungs GmbH, operator of the German Dual System Interseroh. “The current case proves that the private sector can create solutions even in crisis situations. Now it is up to ELS, to bring this solution to a close.“

The customers of ELS are now also requested to act: They must register with one of the remaining dual systems immediately, in order to comply with the legally prescribed participation of their packaging quantities in a dual system. 

“The irregularities that were seen at ELS have shown that the past discussions about uniform regulations were more than justified”, continues Müller-Drexel. “We are happy that with the entry into force of the new German Packaging Act, from the coming year, a clearly defined competition for technical performance will once again take place“ 

In mid-March, ELS applied for renovation under self-administration, and submitted overdue notifications of volumes to clearing points. The details revealed irregularities in the previous notifications of quantities since the start of the system operation by ELS. The liabilities towards the other system operators total a mid eight-figure amount.
